Terms of Service

Welcome to the Tawqeet bot. By using this bot in your Discord server, interacting with it as a member, or signing in to the (web) dashboard, you agree to be bound by the following terms of service. Please read them carefully.

1. Definitions

For the purposes of these terms, the following terms shall have the meanings set out next to each:

• The Service: the Tawqeet bot, the dashboard, reports, commands, the points and engagement system, and the AI assistant.
• The Developer: the Tawqeet team, owner and operator of the Service.
• Server Owner: the account or entity that owns or manages the Discord server to which the Service is added.
• Authorized Administrator: any user granted administrative permissions related to the Service by the Server Owner.
• Member: any user in a Discord server who interacts with the Service or whose data appears in its records.
• Server Data: attendance records, settings, reports, logs, and engagement data associated with the server.

2. Acceptance of Terms

By inviting the bot to a server, using any of its slash commands, interacting with its buttons and menus, or signing in to the dashboard via Discord OAuth2, you acknowledge that you have read, understood, and agreed to these terms and to the associated Privacy Policy.

3. Description of the Service

The Tawqeet bot is an integrated attendance-tracking system within the Discord platform, and includes:

• Discord bot: integrated interaction and management including the engagement system (engagement and levels), manual and automatic check-in/check-out, report generation, alerts, and command logs.
• Engagement and levels system: calculating members' levels and granting automatic roles based on their text and voice engagement, using fair cooldown and filtering systems.
• Dashboard (web): a web interface for management, analytics, and reports, including charts, Excel export, and settings management.
• AI assistant: a smart, AI-powered data analyst that answers attendance and analytics questions.

4. Eligibility and Age

By using the Service, you acknowledge that you have the legal capacity required to accept these terms, or that you use it under the supervision of a guardian or an authorized party where required. The Service complies with the minimum age set in Discord's Terms of Service. The Server Owner is responsible for ensuring the appropriateness of using the Service within their server in accordance with Discord's rules and applicable laws.

5. Acceptable Use

The bot and dashboard must be used only for their intended purposes. The following is strictly prohibited:

• Exploiting any software vulnerabilities in the bot, dashboard, or APIs.
• Attempting to flood the bot or website with requests (Spamming/DDoS) to disrupt the service.
• Attempting unauthorized access to the data of other servers you do not have permission over.
• Using the AI assistant for purposes outside the scope of the attendance and analytics system.
• Manipulating attendance or points data through illegitimate means.
• Using the bot in servers that violate Discord's Terms of Service.
• Impersonating other users or linking accounts you do not own or supervise.

6. Prohibition of Entering Sensitive Data

Users are prohibited from entering or sending sensitive or unnecessary data within the Service's commands or the AI assistant, including health or financial data or any personal data that does not need to be processed for the purpose of attendance and analytics. The user alone bears responsibility for any content they send in violation of this.

7. Administration Permissions and Responsibility

• Server administrators are responsible for managing the bot's settings in their servers, including assigning roles and reports.
• Modifying attendance times (/modifytime) and deleting records (/reset) are the responsibility of the executing administrator.

The Server Owner and authorized administrators are responsible for managing permissions within Discord and the dashboard, including determining who has permission to modify, delete, or export records, or change attendance settings. The Developer is not responsible for any modification, deletion, or export performed from an account holding permission within the server, unless it is proven to result from a security flaw on the part of the Service.

8. Data Protection

• The Server Owner or authorized administrator acknowledges that using the Service may require processing the data of server members, including Discord IDs, attendance records, engagement data, settings, and operational logs. They commit to obtaining the necessary consents or providing the necessary notices to server members where the regulations require it.
• When using the AI assistant, the question and a limited context of attendance and analytics data may be sent to an external AI service provider solely for the purpose of processing the request.
• The Privacy Policy details the types of data, the purposes and basis of processing, retention periods, external parties, transfers outside the Kingdom, and the rights of data subjects.

9. Points and Engagement System

• Points earned from attendance or voice and text engagement are virtual points within the Tawqeet system only and have no monetary or material value.
• Server administrators may customize the engagement system settings, such as the message counting method (words or fixed) and voice presence, or disable it entirely.
• No liability falls on the Developer as a result of losing points, cumulative levels, or resetting them.
• The system may filter or ignore very rapid messages and voice (Spam/Cooldown) to ensure fair distribution of levels and points.

10. AI Assistant

• The AI assistant uses a third-party AI model (Google Gemini via OpenRouter) to process questions.
• Your question is sent along with attendance-data context to the AI provider. Responsibility for the content sent lies with the user.
• The AI assistant's responses are analytical and not final — they may contain interpretation errors. Verifying the data via official reports is recommended.
• Usage is limited to 15 questions per day and two per minute per user.
• Conversations are automatically deleted after 7 days.

11. Intellectual Property

• All intellectual property rights in the Tawqeet bot, the dashboard, and the trademark are reserved to the Developer.
• Copying, modifying, or redistributing the source code or design without prior written permission is not permitted.
• Data created by users (attendance records) remains the property of their server, and their administrators may export or delete it.

12. Third-Party Services

The system relies on external services and platforms that are subject to their own terms:

The discontinuation of these services, or changes to their APIs, policies, prices, or technical limits, may cause some of the Service's features to break, be modified, or be discontinued. The user acknowledges that the Developer does not control these external services and does not guarantee their continuity, and that their data may be subject to those services' terms when interacting with them.

We are not responsible for any changes to these services' policies or for their interruption.

13. Backup and Data Export

The Server Owner and authorized administrators are responsible for exporting periodic backups of the data that matters to them. The Service is not a substitute for official archiving or human-resources systems. The Developer may apply retention, deletion, or archiving policies for data in accordance with what is stated in the Privacy Policy or as required by technical and operational requirements.

14. Limitation of Liability

• To the extent permitted by law, the Service is provided “As Is” and as available, without any express or implied warranties regarding continuity of operation, freedom from errors, or data loss resulting from causes beyond reasonable control.
• The Developer is not responsible for data loss resulting from technical failures, service interruption, or failures of external service providers (Discord, OpenRouter).
• The Developer is not responsible for the accuracy of reports or AI assistant analyses in the event of service interruption or connection problems.
• The Developer is not responsible for any indirect or consequential damages, loss of profits, or administrative decisions made by server users based on the reports.

Nothing in these terms limits liability that may not be excluded by law, including cases of fraud, gross negligence, or violation of a mandatory legal rule.

15. Changes to the Service and Terms

• We may modify these terms from time to time. Non-material changes take effect from the date of their publication, while material changes take effect after being announced via the website, the dashboard, or the support server at least 7 days in advance, unless required for urgent security or legal reasons.
• We reserve the right to modify, add, or remove features of the Service, or to suspend it temporarily for maintenance or permanently.
• Your continued use of the Service after the effective date of the changes constitutes acceptance of them. If you do not agree to the changes, you must stop using the Service and remove the bot from the server.

16. Service Termination and Banning

• The Developer has the right to suspend, terminate, or restrict access to the Service upon violation of these terms or misuse, via the blacklist system that prevents access to the bot and dashboard.
• Action may be taken immediately and without prior notice if the violation relates to the security of the Service, an attempted breach, serious misuse, infringement of others' rights, or violation of applicable laws.
• In non-urgent cases, the Developer may issue a warning or request correction of the violation within a reasonable period before termination.
• Maintenance mode may be activated to temporarily suspend all interactions except for the Developer.

Upon termination or removal of the bot, the Server Owner may request an export of their available data within 14 days (via the dashboard while available or via the official email), unless retention or export is prohibited by law, technically, or is connected to misuse.

17. The Service Is Not an Official HR System

The Service is not an official system for human-resources management, proof of an employment relationship, or the calculation of wages or penalties, unless the server's entity expressly adopts it within its internal regulations. Decisions regarding attendance, penalties, rewards, or any administrative decisions remain the responsibility of the Server Owner or the entity using the Service.

18. Command Logs and Evidence

The Service may retain operational logs including the executed commands, the time of execution, the user ID, and the server ID, for purposes of security, auditing, technical support, and preventing misuse, in accordance with the Privacy Policy and applicable laws.

19. Governing Law and Jurisdiction

These terms are governed by and construed in accordance with the laws in force in the Kingdom of Saudi Arabia. Territorial and subject-matter jurisdiction lies with the competent judicial authorities in the Kingdom of Saudi Arabia, unless mandatory laws provide otherwise.

20. Governing Text

In the event of any discrepancy between the Arabic version and other translations of these terms, the Arabic version is the authoritative reference.
